Apple is a little bit confusing for beginners, however this should clear up all the issues you are having. The most common mistake people make is when they do a different method meant for a different country as Apple is country dependent.

USA:
1) Once unit is delivered, start a return.
2) FTIDv3 the label.
3) Phone them up a few days after it has been returned asking for an update, they will escalate the request and refund you.
